Terms of Service

Last updated: 15 October 2026

1. Who these terms are with

SitomoPlay is operated by Sitomo Play, MB, a mažoji bendrija registered in the Republic of Lithuania under company code 306278568, registered address Didlaukio g. 88-10, LT-08332 Vilnius, Lithuania ("we", "us", "SitomoPlay"). By creating an account or using SitomoPlay, you agree to these terms. See also our Privacy Policy,Cookie Policy and Legal Notice.

2. Who can use SitomoPlay

You must be at least 18 years old and able to form a binding contract to create an account or to play in a pool without one. By joining a pool without an account you confirm this and accept these terms. You must not use SitomoPlay if you are located in, or ordinarily resident in, a country or region subject to Lithuanian, European Union or United Nations sanctions, or if you are listed on any applicable restricted-party list.

3. Your account

You're responsible for keeping your login details and any codes we send you confidential, and for all activity that happens under your account. Every sign-in requires a one-time code sent to your email — this can't be turned off, and helps protect your account even if your password is compromised. Tell us immediately if you suspect unauthorised access.

4. What SitomoPlay is

SitomoPlay lets a group of people organise a recurring game night as a championship — seasons, games, results, statistics, polls, "moments" (posts), messages and blind/round timers. Championships are created and run by their members; we don't referee games, verify results, or resolve disputes between players. A championship's owners are responsible for its settings, membership, content and plan.

SitomoPlay also offers pools — one-off guessing games (for example, guessing a baby's birth date and weight) that anyone with the pool's code can join, with or without an account. A pool is created and run by its organiser, who sets the questions and enters the real answers; we don't verify those answers or resolve disputes about them.

5. Buy-ins, rebuys, bounties and prizes are points, not money

SitomoPlay lets a championship record buy-ins, rebuys, bounties and a prize pool, and can calculate a prize split by finishing place and a settlement summary between players. Every one of these values is a number of points with no monetary value — SitomoPlay has no concept of currency in games. It's a scoreboard, not a payment system.

  • SitomoPlay never collects, holds, transmits or pays out real money in connection with a game, buy-in, rebuy or prize.
  • SitomoPlay never takes a rake, house fee, commission or any other share of a game, buy-in, rebuy or prize. The price of a plan (section 9) is for use of the software only and does not depend on what happens in your games.
  • If real money changes hands between players based on these figures, that is a private arrangement between the players themselves, entirely outside SitomoPlay, and we are not a party to it.
  • You are solely responsible for making sure any such arrangement is lawful where you and the other players are located — this varies by country and we do not advise on it.
  • Pool scores are points too. SitomoPlay has no entry fees, stakes or payouts for pools; any stake players agree among themselves is a private arrangement on the same terms as above.
  • SitomoPlay is not a gambling operator, bookmaker, payment service provider or escrow service, and nothing in the app should be read as offering those services.

6. Content you and others create

You keep ownership of the moments, comments, poll answers, messages, photos and other content you post. By posting it, you grant its intended audience within the relevant championship — the other members for public content like moments, or only the message's chosen recipients for a message — and SitomoPlay, a licence to store, display and distribute it within the app for the purpose of running that championship. For photos, the licence also covers resizing and re-saving them, which we do to every uploaded photo to remove hidden details such as its location. Game results, activity log entries and similar shared history belong to the championship as a whole — see thePrivacy Policy for what happens to this content if you delete your account.

In a pool, your guesses are private until the organiser publishes the results; from then on, every player in that pool and its organiser can see them. Pool names, descriptions and questions are visible to anyone with the pool's code.

7. Acceptable use

You agree not to:

  • post content that is illegal, harassing, hateful, defamatory, or infringes someone else's rights;
  • use SitomoPlay to facilitate anything unlawful, including unlawful gambling;
  • try to gain unauthorised access to another account, championship, or to our systems;
  • interfere with the normal operation of the service (for example, through automated scraping or abuse of the invitation or notification systems);
  • impersonate another person or misrepresent your affiliation with a championship;
  • upload a photo you don't own or don't have permission to share;
  • upload a photo where someone can be recognised without their consent, or, for a child, without the consent of their parent or guardian; or
  • upload sexual, explicit, violent or otherwise graphic images.

We may remove content or suspend or terminate accounts that breach these terms. A championship's owners can also remove members or content from within their own championship.

To report content you believe is illegal or breaks these terms, including a photo of you posted without your consent, email info@sitomoplay.com. Say where the content is (the championship and what it shows) and why you're reporting it. We'll review your report and let you know what we decided. If we remove your content or restrict your account, we'll tell you why.

8. Intellectual property

SitomoPlay's name, branding, and the app itself (excluding content you create) belong to us or our licensors. Nothing in these terms transfers that to you. If you send us feedback or suggestions through the app, you agree we can use them to improve SitomoPlay without payment or attribution to you.

9. Plans and payments

Every account gets one free championship — the first one it creates — within the limits shown on thePricing page. Other championships, and a free championship that outgrows those limits, need a paid plan. Prices are shown on the Pricing page and, in your currency and including any applicable tax, at checkout.

  • Who you buy from. Plans are sold by Paddle.com Market Limited, our reseller and merchant of record. Paddle takes the payment, issues invoices and handles refunds, and your purchase is also subject to Paddle'sbuyer terms.
  • What a plan covers. A plan belongs to one championship and sets how many members it can have. Any owner of that championship can buy, change, cancel or resume its plan; the owner who pays manages the card and invoices.
  • Billing and renewal. Plans are billed annually in advance and renew automatically each year until cancelled. If a renewal payment fails, Paddle retries it for a period and the plan stays active meanwhile.
  • Changing plan. Moving to a bigger plan takes effect straight away and you pay the difference for the rest of the current year, shown before you confirm. Moving to a smaller plan takes effect at the next renewal, with no partial refund; its smaller member limit applies from the moment it is scheduled.
  • Cancelling. Cancelling stops the next renewal; the plan stays active until the end of the period already paid for. When a plan ends, the championship stays visible to its members but can't get new seasons, games or members until an owner buys a plan again. Deleting a championship, deleting the account that pays for its plan, or the payer leaving it or stopping being an owner also stops the plan renewing, without a refund for the rest of the period.
  • Refunds and your right to withdraw. Apart from the cases above, refunds are handled by Paddle under its buyer terms, which also set out any right you have as a consumer to withdraw from a purchase. Nothing in these terms limits your statutory consumer rights.

10. Suspension and termination

You can delete your account at any time from Profile → Delete account. We may suspend or terminate your access if you breach these terms, if required by law, or if we discontinue SitomoPlay. Sections of these terms that by their nature should survive termination (including intellectual property, disclaimers, liability and governing law) will continue to apply.

11. No warranty

SitomoPlay is provided "as is" and "as available". We don't guarantee it will be uninterrupted, error-free, or that recorded results and statistics will always be accurate — championships rely on members entering data correctly. To the fullest extent the law allows, we exclude all warranties not expressly stated here.

12. Limitation of liability

To the fullest extent permitted by law, our total liability to you for any claim arising from these terms or your use of SitomoPlay is limited to the amount paid for your plans in the 12 months before the claim arose, or €25 if you have paid nothing. This limit does not apply to, and nothing in these terms excludes or limits, liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, gross negligence, or anything else that cannot lawfully be excluded or limited, including statutory rights you have as a consumer under EU or your local law.

13. Indemnity

You agree to indemnify us against reasonable losses and costs arising from your breach of these terms or misuse of SitomoPlay, except to the extent caused by our own breach or negligence.

14. Governing law and disputes

These terms are governed by the laws of the Republic of Lithuania, without prejudice to any mandatory consumer-protection rights you have under the law of the country where you live. If you have a complaint, please contact us first atinfo@sitomoplay.com. If you are a consumer and we can't resolve it, you can refer it to the State Consumer Rights Protection Authority of Lithuania (vvtat.lrv.lt), which handles consumer disputes out of court, or to the consumer authority or courts where you live.

15. Changes to these terms

We may update these terms from time to time. The "last updated" date above reflects the latest version, and where a change is significant we will notify members through the app or by email. Continuing to use SitomoPlay after a change takes effect means you accept the updated terms.
